BOSTON – A Boston University student has been ordered to pay $675,000 to four record labels for illegally downloading and sharing music.
Joel Tenenbaum, of Providence, R.I., admitted he downloaded and distributed 30 songs. The only issue for the jury to decide was how much in damages to award the record labels.
Under federal law, the recording companies were entitled to $750 to $30,000 per infringement. But the law allows as much as $150,000 per track if the jury finds the infringements were willful. The maximum jurors could have awarded in Tenenbaum's case was $4.5 million.
The case is only the nation's second music downloading case against an individual to go to trial.
Last month, a federal jury in Minneapolis ruled a Minnesota woman must pay nearly $2 million for copyright infringement.

Dear VacLib Members and Friends - Wanted to give you all a heads up on state issued exemption forms. I haven't had to deal with this personally for several years, and I always crossed out sentences or clauses, and often adding some of my own, before signing their exemption of medical release type of forms. When Donna Carrillo began to diligently search out existing exemption forms and posting them, I read over a couple of them and encouraged people to make up their own whenever possible. After having a "closer encounter" with such a form - a form provided to the state of Idaho by the American Academy of Pediatrics and the Centers for Disease Control and Prevention and used by licensed Idaho daycares, I was shocked into the VERY REAL danger of signing these forms without changing them significantly.
Any form one affixes their initials to, dates and affixes their signature to at the end is a LEGAL document. All statements prior to your signature you must agree to fully OR restrict your signature to say that you are signing under TDC - threat, duress, and coercion. The form that my daughter was told she needed to fill out for this daycare is posted here: iris.idhw.state.id.us/irisweb/pdf/ChildCareExemptForm.pdfOn this form, she crossed out all the "nots" and in her personal statement she further clarified that she understands fully the risks of vaccinating her child. I have since found out that most public schools and daycares in other states also use a similar form. Basically, by initialing and signing this form as is, you are admitting to understanding that "vaccine preventable" diseases are extremely deadly and ALSO admitting to negligence for willfully denying your son/daughter the life saving protection that vaccines offer. These forms are MEANT to not only be intimidating but to catch the legally ignorant off guard. This is very serious to me since all states have adopted the federally funded Child Abuse Prevention and Treatment Act which gives states the right to literally steal your children for up to 48 hours -- the time they have to prove child neglect OR abuse. If it were ME, I would insist that they accept a form that I provide them since it satisfies the law. If there are any problems or they insist on me using their form, I would cite the law and ask the school or daycare provider where it actually says in state statute that this particular form is the only form that will satisfy the law. NASSAU, Bahamas – Miss Venezuela was the fairest of them all, again.
Venezuelan Stefania Fernandez won the 2009 Miss Universe pageant in the Bahamas on Sunday night.
Dressed in a flowing red gown, Fernandez embraced runner up Miss Dominican Republic as the announcement was made, and received the crown from last year's winner, Dayana Mendoza, of Venezuela. The sparkling tiara fell to the floor at one point, as Fernandez danced in joy.
Venezuela, a beauty-obsessed South American country, has won the Miss Universe pageant six times.
During a question-and-answer segment with the five top finalists, Fernandez said she believed women have overcome obstacles such as hitting the proverbial glass ceiling.
"I feel we have reached the level that men are at," she said.
The other top-five finalists were runner-up Ada Aimee de la Cruz, followed by Miss Kosovo [!Not recognized as a legitimate nation by most of the United Nations countries and a brutal, Bush/-heney regime/CIA-contructed fake statelet divided by the U.S.-NATO miitary occupiers from Serbia], Droga Ganusha; Miss Australia, Rachael Finch; and Miss Puerto Rico [also not a real, independent nation but a US colony! And "coincidentally" a Caribbean neighbor of Nassau where this sick farce is being staged], Mayra Matos Perez.
The top 15 finalists appeared in bathing suits before the final 10 were chosen for the evening gown segment.
Pageant co-owner Donald Trump told reporters, "I think this is the most beautiful group of women I've ever seen."
The televised event includes musical performances by Flo Rida, Heidi Montag, David Guetta and Kelly Rowland.
Montag gave her first live performance, singing "Body Language" from her debut album.
Fans cheered on the blond star of MTV's "The Hills," although NBC, which is broadcasting the event in the Bahamas live, blocked out more than half of her performance as they introduced the 15 finalists.
"It's my first performance live and it's in front of a billion eyes. So I'm very excited to show everyone what I'm coming with," said Montag before her performance.
Hosts are Billy Bush [NEPHEW OF CIA DIRECTOR GEORGE BUSH SR.'S SON GEORGE BUSH JR. THE USA "PRESIDENT" FOR EIGHT YEARS], co-anchor of "Access Hollywood," and Claudia Jordan, a former Miss Rhode Island USA who has appeared on several TV shows. [CIA-]CNN's Lou Dobbs problem just got a whole lot worse. On September 15 and 16, Dobbs is scheduled to broadcast his radio show from Capitol Hill as a leading voice of the annual "Hold Their Feet to the Fire" legislative advocacy conference and rally sponsored by the rabidly anti-immigrant organization Federation for American Immigration Reform (FAIR). Founded by a man with a history of espousing racist beliefs and who remains on its board, FAIR is labeled as a "hate group" by the Southern Poverty Law Center. Dobbs' participation -- and, through him, CNN's -- will bestow mainstream legitimacy on the rally and on FAIR, something FAIR recognizes and is bragging about to its members. Dobbs must not be allowed to participate in this event. Email CNN and ask them to stop Dobbs: mediamatters.org/stopdobbsCNN's association with FAIR through Dobbs is a major stain on an organization that calls itself "the most trusted name in news." FAIR was founded by John Tanton, a man who has a long history of making racist statements. In 1986, Tanton reportedly wrote: "As Whites see their power and control over their lives declining, will they simply go quietly into the night?" In 2001, Tanton even praised the work of John Trevor, a notorious Nazi sympathizer, saying his work should form "a guidepost to what we must follow again this time."FAIR has been sharply criticized in the past for funding racially charged ads, including several in 2004 targeting former Democratic Rep. Martin Frost and former Republican Sen. Chuck Hagel that featured dark-skinned men loitering on street corners and running from the police. And yet, rather than denouncing the group, Dobbs is scheduled to be a leading voice at the upcoming FAIR rally. What's more, his CNN show has cited FAIR as a credible source on immigration issues no fewer than six times in the last year. National Security Council Report 68 (NSC-68) was a 58-page classified report issued by the United States National Security Council on April 14, 1950, during the presidency of Harry S. Truman. Written during the formative stage of the Cold War, it has become one of the most significant historical documents of the Cold War.
NSC-68 would shape U.S. foreign policy in the Cold War for the next 20 years and has subsequently been labeled its "blueprint." Truman officially signed NSC-68 on September 30, 1950. It was declassified in 1975.[1]

[edit] Inception By 1949, events had reinforced the need for better coordination of national security policy: the North Atlantic Treaty Organization (NATO) was formed, military assistance for Europe was begun, the Soviet Union detonated an atomic bomb, and the Communists won control in China over the Nationalists. The United States Department of State seized the opportunity to review U.S. strategic policy and military programs, overcoming opposition from Secretary of Defense Louis Johnson and his allies in the Bureau of the Budget. Initially sidestepping formal National Security Council (NSC) channels, State won approval of an ad hoc interdepartmental committee under its Policy Planning head, Paul Nitze. Their report was NSC 68, begun in February 1950 and concluded the following April. NSC Study Group (Known)

Major General Truman Landon, Joint Chiefs Representative Originally, President Truman did not support NSC-68 when it was first brought to him in 1950. He believed that it was not specific about which programs would be affected or changed and it also didn't go well with his previous defense spending limits. Truman sent it back for further review until he finally approved it in 1951. [2]
The document outlined the de facto national security strategy of the United States for that time (though it was not an official NSS in the form we know today) and analyzed the capabilities of the Soviet Union and of the United States of America from military, economic, political, and psychological standpoints.
The NSC-68 described the challenges facing the United States in cataclysmic terms. "The issue that faces us are momentous," the document stated, "involving the fulfillment or destruction not only of this Republic but of civilization itself." [3]
[edit] Content and meaning NSC-68 made the case for a U.S. military buildup to confront what it called an enemy "unlike previous aspirants to hegemony... animated by a new fanatic faith, antithetical to our own." The Soviet Union and the United States existed in a polarized world, in which the Soviets wished to "impose its absolute authority over the rest of the world." This would be a war of ideas in which "the idea of freedom under a government of laws, and the idea of slavery under the grim oligarchy of the "Kremlin" were pitted against each other. Therefore, the U.S. as "the center of power in the free world," should build an international community in which American society would "survive and flourish" and pursue a policy of containment. The document drew from the writings of George F. Kennan, specifically the 1946 "Long Telegram" and the subsequent X Article.
Although Kennan's theory of containment articulated a multifaceted approach for U.S. foreign policy in response to the perceived Soviet threat, NSC-68 recommended policies that emphasized military over diplomatic action. Kennan's influential telegram advocated a policy of containment towards the Soviet Union. In NSC-68, it can be defined as "a policy of calculated and gradual coercion." That said, the NSC-68 called for significant peacetime military spending, in which the U.S. possessed "superior overall power" and "in dependable combination with other like-minded nations." It calls for a military capable of:
Defending the Western Hemisphere and essential allied areas in order that their war-making capabilities can be developed; Providing and protecting a mobilization base while the offensive forces required for victory were being built up; Conducting offensive operations to destroy vital elements of the Soviet war-making capacity, and to keep the enemy off balance until the full offensive strength of the United States and its allies can be brought to bear; Defending and maintaining the lines of communication and base areas necessary to the execution of the above tasks; and Providing such aid to allies as is essential to the execution of their role in the above tasks. NSC-68 itself did not contain any specific cost estimates. The programs would cost, by estimates, a significant portion, perhaps more than the 20% of GDP the United States was already committing to defense. It was evident that the limits the President had previously set on defense spending would not be compatible with NSC-68.[4] NSC-68 required that the United States must increase defense spending to as much as $50 billion per year from the original $13 billion set for 1950.[5] However the specific costs were left to subsequent groups in the NSC to analyze and budget.

NSC-68 drew some criticism from those who believed the Cold War was being escalated unnecessarily. When the report was sent to top officials in the Truman administration for review before its official delivery to the President, many of them scoffed at its arguments. Willard Thorp questioned its contention that the "USSR is steadily reducing the discrepancy between its overall economic strength and that of the United States." Thorp argued: "I do not feel that this position is demonstrated, but rather the reverse... The actual gap is widening in our favor." He pointed out that in 1949 the US economy had increased twofold over that of the Soviet Union. Steel production in the US outpaced the Soviet Union by 2 million tons, and stockpiling of goods and oil production far exceeded Soviet amounts. As for Soviet military investment, Thorp was skeptical that the USSR was committing such large portion of its GDP: "I suspect a larger portion of Soviet investment went into housing." William Schaub of the Bureau of the Budget was particularly harsh, believing that "in every arena," the Air Force, the Army, the Navy, the stockpiling of atomic bombs, the economy, the US was far superior than the Soviet Union. Kennan, although "father" of the containment policy, also disagreed with the document, particularly its call for massive rearmament (FRUS, 1950, Vol. I).
President Harry S. Truman, even after the Soviets became a nuclear power, sought to curb military spending. However, he did not reject the recommendations of NSC-68 out of hand, instead returning it to circulation and asking for an estimate of the costs involved. In the ensuing two months little progress was made on the report. By June, Nitze had practically given up on it. But on June 25, 1950, North Korean forces crossed the 38th parallel in their attempt to unify the two Koreas. [1]) With the Korean War begun, NSC-68 took on new importance. As Acheson later remarked: "Korea... created the stimulus which made action."[6] The Korean War led most Americans to conclude that the Soviet Union was indeed bent on world domination, and spurred the mobilization of significant resources to counter the perceived threat.

NSC-68 is a source of much historical debate as is the escalation of the Cold War. NSC-68 was an important part of an overall shift in American foreign policy to a comprehensive containment strategy that was confirmed by successive administrations. Analyses ranges from Michael Hogan's belief that NSC-68 portrayed the threat "in the worst light possible" to providing an accurate picture of a genuine and growing threat.

This document is critical to understanding the Cold War with its effect on similar national security documents such as the National Security Strategy March 2005, but also provides insight to current US foreign policy. Although the proposal was initially refused, implementation of NSC-68 shows the extent to which it marked a 'shift' in US policy - not only toward the USSR but toward all communist governments. By signing the document, Truman provided a clearly defined and coherent US policy that did not really exist previously. Furthermore, it can be argued that NSC 68, as proposed by the NSC, addressed Truman's problem of being attacked from the American right following the "red scare" and Alger Hiss case. Although not made public, NSC 68 was manifested in subsequent increases in America's conventional and nuclear capabilities, thereby adding to the country's financial burden.

But it takes sharp aim at Washington for giving the U.N. nuclear watchdog unspecified intelligence and other evidence. "By interfering in the work of the IAEA and exerting various political pressures, the government of the United States attempted to spoil the cooperative spirit between the Islamic Republic of Iran and the IAEA," the letter reads. "The government of the United States has not handed over original documents to the agency since it does not in fact have any authenticated document and all it has are forged documents," Soltanieh said. "The agency didn't deliver any original documents to Iran and none of the documents and materials that were shown to Iran have authenticity and all proved to be fabricated, baseless allegations and false attributions to Iran," he added. "Therefore, this subject must be closed," Soltanieh wrote. U.S. officials were not immediately available for comment late Friday. The IAEA itself has pressed the U.S. and other governments to share more details on Iran-related intelligence. In its latest report on Iran, the U.N. agency noted that "constraints placed by some member states on the availability of information to Iran are making it more difficult for the agency to conduct detailed discussions with Iran." The nuclear agency's latest assessment did acknowledge that Iran has been producing nuclear fuel at a slower rate and has allowed U.N. inspectors broader access to its main nuclear complex in the southern city of Natanz and to a reactor in Arak. But it cautions that there are "a number of outstanding issues which give rise to concerns and which need to be clarified to exclude the existence of possible military dimensions." The report, to be examined next week, has raised the specter of harsher international sanctions against Iran for not answering lingering questions about its nuclear activities. Senior U.N. officials have said Iran has been feeding uranium ore into some of its 8,300 centrifuges at a reduced rate, suggesting that sanctions already in place may be hampering its program. As of Aug. 12, only about 4,600 of those centrifuges were actively enriching uranium, compared with about 4,900 in June — the last time the nuclear agency issued a report on Iran's nuclear activities — officials said. Since then, they said, Iran has installed roughly 1,000 more centrifuges, but it appeared that many were idle. Soltanieh's letter contends the overall assessment on Iran is positive. But he says concerns raised by the U.S. and others have "totally overshadowed and undermined" the steps that Iran has taken to comply with IAEA demands for transparency. President Barack Obama has given Iran something of an ultimatum: Stop enriching uranium — which, if done at a high level, can produce fissile material for the core of a nuclear weapon — or face harsher penalties. In exchange for stopping, it could get trade benefits from six countries that have been engaging it in separate talks: the U.S., Britain, China, France, Germany and Russia. The U.N. Security Council has imposed sanctions on Iran three times since 2006 for its refusal to freeze uranium enrichment. The sanctions grew from fears that Iran is using the pretext of building a peaceful nuclear energy program to eventually make weapons-grade enriched uranium. The resulting vaccination map would allow swift intervention in neighborhoods left vulnerable to the fast-moving respiratory illness. The trial starts this afternoon, when several hundred people are expected to queue up for immunizations at the headquarters of the Boston Public Health Commission. Each of them will get a bracelet printed with a unique identifier code. Information about the vaccine's recipients, and the shot, will be entered into handheld devices similar to those used by delivery truck drivers. Infectious disease specialists in Boston and elsewhere predicted that the registry approach could prove even more useful if something more sinister strikes: a bioterrorism attack or the long-feared arrival of a global flu epidemic. In such crises, the registry could be used to track who received a special vaccine or antidote to a deadly germ."Anything you can do to better pinpoint who's vaccinated and who's not, that's absolutely vital," said Michael Osterholm, director of the Center for Infectious Disease Research & Policy at the University of Minnesota. "I wish more cities were doing this kind of thing." Boston is believed to be the first city to embrace this particular approach to tracking vaccinations against the seasonal flu, estimated to kill 36,000 people each year in the United States, principally the elderly. But when Boston bought the monitoring system from a Milwaukee company in 2006, emergency authorities had a far different use in mind: tracking people injured in big fires, plane crashes, or other disasters. "When there's a large catastrophic event, people end up in a variety of healthcare facilities," said Dr. Anita Barry, Boston's director of communicable disease control. "Of course, their family members and loved ones are trying to find out where they are and how they're doing." To see how well the system would work, emergency crews tested it at the Boston Marathon and the Fourth of July extravaganza on the Esplanade. The trial proved successful. "If we can make it work in the Boston Marathon medical tent, then you have to think about making it so that it can work in other environments as well - whether it's a community clinic or a doctor's office or a flu shot clinic," said Rich Serino, chief of Boston Emergency Medical Services. Thus, the idea to use the registry as a flu vaccine tracker was born. Every autumn in medical offices across the country, flu vaccine floods in. The perishable medical product must be delivered to millions in a matter of months.Continued... Keeping track of that cache of vaccine - and which patients are getting it - is a daunting proposition. In some medical offices, the information is entered into electronic medical records. At Boston's health department, nurses fill out paper forms. But there's never been any way to systematically monitor whether, for example, Dorchester has lower vaccination rates than the North End. "When you're working in one clinic, you don't have a good sense of that," said Dr. Alfred DeMaria, top disease doctor at the Massachusetts Department of Public Health. "But if you're tracking multiple clinics in real time, you can see where the uptake is better and where it's less, and then focus on outreach." Today's experiment, which does not require any additional direct spending, is a first step toward that. When people arrive for their shots, they will get an ID bracelet with a barcode. Next, basic information - name, age, gender, address - will be entered into the patient tracking database. There will be electronic records, too, of who gave the vaccine and whether it was injected into the right arm or the left, and time-stamped for that day. The resulting trove of data could be used to figure out why some patients had to wait longer than others to be vaccinated. "When all is said and done," said Jun Davantes, director of product management at EMSystems, the company that makes the technology, "Boston will be able to identify where there are certain bottlenecks in the process and hopefully improve it the next time around." Ultimately, city health authorities said, they envision creating a network across the city that would allow public and private providers of flu shots to add data to a registry. But acknowledging patients' privacy concerns, officials promised that if a citywide system were implemented, only a limited amount of information would be gathered - all sitting behind an encrypted firewall. "I have had people say, 'Oh, that's so big brother,' " said Laura Williams, EMS deputy chief of staff. "But in truth, the unique identifier is unique to the incident. Heritage Health Concepts will be giving flu shots on Monday, October 5 from 10-11:30am in 1505, Suite 155. The charge for the seasonal flu vaccine is $18. They will have the swine flu vaccine available as well. Their policy for distributing the swine flu vaccine is as follows:
1. If we are able to give both vaccines at the same event, we will be offering the swine flu vaccine for no additional charge if given to the participant at the same time as the seasonal flu vaccine.

Get Breaking News Alerts After much deliberation and an unprecedented three rounds of post-oral argument supplemental briefing, the Fifth Circuit Court of Appeals is primed to issue a judgment on the appeal of prominent Mississippi attorney Paul Minor. Minor was wrongly accused and convicted of bribery stemming from his campaign fundraising for two Democratic candidates for state judgeships in Mississippi. The appellate court has undertaken an extensive, thoughtful review of Minor's case, repeatedly asking the government to document and explain the quid pro quo "this for that" deal necessary to put -- and keep -- Minor behind bars. The judges have also questioned whether the government incorrectly applied the federal bribery statute in Minor's case, and whether charges against Minor regarding one of the judges amounted to constitutional double jeopardy. Minor was originally indicted in 2003 in what many believe was a targeted political prosecution, ginned up by Karl Rove's GOP cronies in the partisan Bush Justice Department. As a successful plaintiff's attorney, Minor posed a threat to corporate interests, including the Chamber of Commerce which largely bankrolled the specious "tort reform" attacks on plaintiffs' rights to sue corporations for illegal behavior. Karl Rove and his GOP operatives, long-time puppets of Big Business, targeted Minor and other Democrats in a coordinated effort to scare off big-ticket donors to the Democratic Party nationwide. In Mississippi, Paul Minor was the prime target as a successful trial attorney who repeatedly won big decisions against corporate interests and fought against tort reform as a champion for the little guy's right to a just day in court. Minor was also the top Democratic fundraiser in the state, and had a keen interest, as an attorney would, in seeing fair, impartial candidates win the state's elected judgeships rather than the business-friendly candidates endorsed by the GOP. In August of 2005 Minor was acquitted on part of the charges and the jury hung on the rest of the charges. Minor was immediately re-indicted by a partisan U.S. Attorney desperate to save his job after learning that his name appeared on a list of U.S. Attorneys recommended for dismissal by Bush White House officials. Minor's campaign contributions to the Democratic candidates were mistakenly ruled "bribes" in the botched 2007 retrial. The conviction resulted in Minor's hefty 11-year sentence for non-violent white-collar crimes he never committed. Minor has languished in a Pensacola prison camp for the past three years, where he recently endured the tragic ordeal of his wife Sylvia passing away after a long battle against brain cancer. Despite the substantial questions raised in his appeal - upon which the federal bail statutes mandate release pending outcome of the appellate review - Minor was repeatedly denied release and never got to say goodbye to his dying wife. Adding insult to injury, Paul was denied a furlough to attend Sylvia's funeral where he planned to deliver a eulogy honoring their 41 years of marriage and to comfort their children in the family's time of loss. But the sun may soon shine again in Minor's brutally interrupted life, as the Fifth Circuit appears poised to rule in his favor on appeal. At oral argument in April, the Court repeatedly posed troublesome questions that the government attorneys struggled to answer. The appellate judges subsequently requested three rounds of post-oral argument supplemental briefing, a rare level of probing that indicates to many observers that the court is likely ready to reverse Minor's conviction. The final round of supplemental briefing was submitted on September 3rd, and the judges could issue a decision at any time. During the botched 2007 retrial, Bush DOJ attorneys glossed over existing case law to persuade the district court not to require critical instructions to jury members that the government must prove a specific quid pro quo deal in order to convict Minor on the federal bribery charges lobbed at him by the partisan, conflicted U.S. Attorney Lampton. As extensively briefed by Minor's lawyers during the appeal, specific quid pro quo proof was clearly required for all of the charges against him. Since the jury was never required to find any proof of a "this for that" quid pro quo agreement for the trumped up charges, the prospect of reversal of Minor's conviction appears not only likely, but mandated under Supreme Court and other case law. The Fifth Circuit is not only deliberating the fate of one man. There are profound First Amendment implications in this case. The failure to instruct a jury that it must find quid pro quo proof in a case involving campaign contributions essentially means that anyone who gives money to a candidate vying for public office could face bribery charges without any underlying proof of a favor or deal promised in return by the recipient. If the court rules that Minor was correctly convicted, it would send shockwaves through the political world, as anyone - including members of Congress and the administration - could be targeted for the long-time tradition of giving campaign contributions to candidates who share the values of donors, an expression of free speech central to our participatory democracy. Amicus briefs recently filed with the Supreme Court supporting former Alabama Governor Don Siegelman's request for Supreme Court review confirm these profound implications. Siegelman was convicted on remarkably similar charges of bribery involving campaign fundraising. Ninety-one former Democratic and Republican state Attorneys General and nine distinguished First Amendment law professors filed amicus briefs with the Supreme Court this week asserting the importance of requiring exacting, explicit quid pro quo proof in such cases. The law professors argue that, absent exacting quid pro quo proof that campaign fundraising actually constituted bribery, both private individuals and public officials who participate in political fundraising could "face the risk that a prosecutor will single them out for prosecution."[PDF] The professors rightly point out that this would "place a chilling effect on the First Amendment right to contribute to political campaigns," activity that is essential to our participatory democracy unless campaigns are publicly funded. Without quid pro quo proof of a deal between donor and recipient, anyone - regardless of political affiliation - could be accused of "bribery" just for giving money to a candidate running for office. The Fifth Circuit's decision in Paul Minor's case will determine if this form of free speech is indeed protected as laid out in the Constitution, or punishable by severe prison sentences dictated by partisan politics.
